Consent with processing of personal data

Material and Technology, s.r.o. (hereinafter referred to as the Material and Technology, or by the abbreviation M&T) processes personal data in accordance with the legislation and regulations in effect in the Czech Republic, most notably, Act No. 110/2019 Coll. on the Protection of Personal Data and the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as Regulation).

The consent is granted to the data controller (hereinafter referred to as "M&T"):

Extent of personal data

The customer is committed to process personal data only in necessary extent related to the purpose of their processing. The extent of provided personal data based on the consent is as follows:

1. identification and address details: address, academic title, name, surname, date of birth, address of permanent or temporary residence, delivery or other contact address;
2. electronic contact details: telephone, mobile phone, e-mail address;
3. other electronic data: IP address, cookies, authentication certificates, identifiers in social networks and communication platforms (eg Skype), location data of the equipment used by the Customer;
4. other personal data related to the contract: bank account number.

Purpose and processing time

The customer agrees to the processing of his personal data for the purposes set out below, to the extent specified below (using the letters set out above) and for the period specified below. The consent provided is valid from the moment it is granted / signed. M&T extent of personal data for the period of processing, as well as after the termination of the contractual relationship (if the contractual relationship established) evaluates and restricted to what is strictly necessary with regard to the processing purposes:

1. sending information messages concerning the interest in demanded products, or similar products and providing advice especially in the area of demanded products and services for the scope of processing a) - d) for the period of existence of the contractual obligation, if a contractual relationship was established, and after its termination; for which there is a risk of asserting legal claims under this contract, extended by 10 years, resp. for a period of 10 years after the granting of this consent, if no contractual relationship has been established;
2. in all cases in any form, including commercial communications disseminated by electronic means provided / provided by the Customer; M&T's intention is to streamline the solution of the Customer's requirements and to improve the quality of products and services provided; M&T in no way wants to and does not intend to bother the Customer with the amount of unsolicited and unrelated marketing communication;
3. obtaining the Customer's opinion concerning in particular the degree of satisfaction with the provided and / or considered M&T products and services, the opinion of M&T, M&T marketing communication for the scope of processing a) - d) for the duration of the contractual obligation, if the contractual relationship was established, and after its termination for the period during which there is a threat of assertion of legal claims under this contract, extended by 10 years, resp. for a period of 10 years after the granting of this consent, if a contractual relationship has not been established.

The customer gives consents for the entire range of processed data and for all the above purposes and the relevant scope. The customer may revoke the provided consent at any time in whole or in part, in the same simple form as it was granted, in a credible form of electronic communication or in writing in paper materialized form. The customer hereby agrees to the said processing of his personal data, therefore the provision of optional personal data for the stated purposes. The customer further expressly declares that he consents to the said processing free of charge and that its granting was not conditioned by the provision of the service / goods.

Information about personal data processing and Customer rights

The Customer's personal data are processed automatically and manually and may be made available to M&T employees if necessary for the performance of their job duties, as well as to processors with whom M&T has a contract on personal data processing and other persons in accordance with applicable law.

The customer has the right to access, correct, delete ("the right to be forgotten"), restrict processing, block incorrect personal data, portability, the right to object to the processing and the right to complain to the supervisory authority (if he considers it that M&T is acting in breach of the GDPR in the processing of personal data), as well as the following information: the categories of personal data concerned; purposes of processing and their legal basis incl. legitimate interests; recipients or categories of recipients for making available (including recipients in third countries or international organizations); the planned period of storage of personal data or, if this cannot be determined, the criteria used to determine this period; information about the source of personal data, if not obtained from the Customer; the fact that automated decision-making, including profiling, takes place, and in these cases also information concerning the procedure used, as well as the significance and expected consequences of such processing for the Customer.

M&T did not appoint a Data Protection Officer, nor did it appoint a representative to perform duties under the GDPR. M&T does not intend to transfer the Customer's personal data to a third country, an international organization or processors other than those cooperating with M&T.

An updated list of personal data processors, as well as comprehensive information on personal data processing and a list of rights and obligations of the Customer and M&T, including instructions on the consequences of partial or complete non-consent, will be provided at the Customer's request at the M&T office at Čs. odboje 1044, 518 01 Dobruška or info@kliky-mt.cz.
